Lucy’s Celebration INC Store Policies

Operating as Lucy’s Celebration Flowers Last updated September 30, 2026

We want every order to bring beauty and joy to your celebration. These policies explain how we handle purchases, delivery, changes, cancellations, and concerns about your order.

  1. Acceptance of These Policies

By placing an order after these policies have been made available to you, whether online, by phone, by message, or in person, you agree to these Store Policies.

These policies apply unless a signed written agreement provides different terms. A signed agreement controls where its terms conflict with these policies. Nothing in these policies limits rights that cannot legally be waived.

“We,” “us,” or “the Business” means Lucy’s Celebration INC, operating as Lucy’s Celebration Flowers, located at 5247 Coconut Creek Pkwy, Margate, FL 33063. “Customer” or “you” means the person placing and paying for the order. “Order” means a purchase of products, services, add-ons, rentals, or an event booking. “Fulfillment” means the scheduled delivery, pickup, or service date and time. You are responsible for providing accurate names, addresses, phone numbers, dates, card messages, and order specifications.

  1. Orders, Pricing and Payment

An order is confirmed when we receive the required payment and issue an order confirmation. An automated payment receipt alone does not confirm availability.

Payment: Standard orders require full payment at purchase. Event orders and qualifying custom orders follow Section 7 or their signed agreement. Accepted methods: We accept the payment methods displayed at checkout or confirmed by our staff. Currency: Prices are in U.S. dollars. Applicable taxes and fees are disclosed before payment. Reservations: Products, delivery slots, and event dates are not reserved until the required payment and any required agreement are received. Pricing errors: If a listing contains a material pricing error, we will contact you before fulfillment. You may accept the corrected price or cancel for a full refund. Business cancellations: If we cancel because we cannot fulfill an order, we will refund payments for the products and services we do not provide. Delivery and service fees: Fees for services already properly performed are generally non-refundable. Unperformed services are handled under the cancellation terms below. Promotions: One promotional code per order unless stated otherwise. Promotions cannot be applied retroactively and have no cash value. Changes to a promotion do not affect an already confirmed order. Gift cards and store credit: If offered, purchased gift cards and store credit do not expire and carry no maintenance or inactivity fees. They are not redeemable for cash except where required by law. Contact us about a lost card; replacement requires sufficient proof of purchase and remaining balance.

  1. Product and Service Descriptions

Our arrangements are individually designed using fresh flowers and available materials.

Photographs: Photos represent the arrangement’s general style, palette, and size. Natural differences in blooms, screens, and lighting may affect appearance. Substitutions: When a flower or container is unavailable, we may substitute an item of equal or greater value while preserving the overall style and color palette as closely as possible. Essential preferences: Tell us before payment if a particular flower, color, container, or exclusion is essential. An exact-item or no-substitution request is binding only when we confirm it in writing. Significant substitutions: If a substitution would substantially change the arrangement’s appearance or purpose, we will seek your approval. If we cannot provide an agreed essential feature, you may choose an alternative or a refund for the affected item. Flower life: Fresh flowers are perishable. Their lifespan depends on variety, temperature, water, handling, and care. We do not promise a fixed lifespan unless specifically stated. Services: Event designs and other services are provided according to the confirmed specifications or signed agreement.

  1. Delivery and Pickup

Delivery

Service area: We generally deliver within 30 miles of our shop, subject to address availability and scheduling. Delivery eligibility and fees are confirmed before payment. Delivery windows: Deliveries occur within the confirmed window. Exact times require our express written acceptance. Same-day orders: Same-day delivery is subject to flower availability and delivery capacity and is confirmed individually. Funerals and timed events: Provide the venue, service time, recipient contact, and any access requirements before ordering. We will confirm whether we can meet the requested timing. Unavailable recipient: We may deliver to an authorized reception desk or building office. We will leave flowers unattended only when authorized and conditions appear suitable. We will not knowingly leave flowers exposed to damaging heat or severe weather. Redelivery: When another trip is necessary because the recipient is unavailable, access is denied, or customer information is incorrect, a $15 redelivery fee within the original delivery area applies. Any additional distance charge is quoted for approval before redelivery. Incorrect address or refused delivery: We will attempt to contact you. Refunds may be reduced by preparation costs, perishable materials, and delivery services already performed. We do not charge redelivery fees for our own delivery errors. After delivery: Please arrange prompt receipt and proper care. We are not responsible for theft or deterioration after correct delivery to an authorized person or customer-approved location, except where caused by our error. Delivery evidence: Photos, timestamps, tracking, and signatures may help establish delivery. We will review credible evidence of an incorrect or missing delivery. Carrier shipments: Any shipment by an outside carrier requires separate confirmation. Report a missing or damaged shipment promptly, preferably within 7 calendar days of the expected delivery date. This reporting request does not reduce rights provided by law. Pickup

  1. Changes and Cancellations

For standard orders, call or text (561) 871-3846, or submit a request through our website contact form. Include your name, order number, and requested change.

We will acknowledge requests promptly. Cancellation eligibility is measured from when we receive your request, rather than when we respond.

Standard order cancellations

When we receive your cancellation

Refund or credit

At least 48 hours before fulfillment, before preparation or special purchasing begins

Full refund

Between 24 and 48 hours before fulfillment, before preparation begins

Store credit for the order amount

Less than 24 hours before fulfillment, or after preparation begins

Generally no refund or credit for prepared products; unperformed delivery or service fees are refunded

Custom, personalized, or specially sourced items

Amounts committed to approved work and nonrecoverable materials are non-refundable; any uncommitted balance is refunded

These restrictions do not apply when we fail to provide the agreed products or services.

Changes: Changes requested at least 48 hours before fulfillment are free when feasible, excluding increased product or material costs. Late changes: Changes within 48 hours are subject to availability. Any additional charge is quoted for approval first. Upgrades: Additional payment is required when the upgrade is accepted. Downgrades: Reductions after preparation or special purchasing begins do not qualify for a refund of committed costs. Event orders: Section 7 and the signed event agreement govern event cancellations and changes.

  1. Returns, Refunds and Quality Claims

Fresh flowers, personalized products, and custom-made arrangements cannot be returned for a change of mind. This does not exclude remedies for defective items, incorrect orders, or our failure to perform.

Reporting a problem

Contact us as soon as possible, preferably within 24 hours of delivery, pickup, or service completion. Provide your order number, a description of the problem, and clear photographs where possible. Retain the product and packaging when practical so we can assess the issue. Prompt reporting is especially important for fresh flowers. A delay may affect our ability to determine the cause, but does not automatically eliminate rights provided by law.

Resolving a valid claim

We will offer an appropriate correction or replacement without additional charge. If a timely correction or replacement is unavailable, we will refund the affected item or service. Store credit may be offered with your agreement.

Nonperishable merchandise

Standard, nonpersonalized merchandise may be returned within 7 calendar days of purchase if unused, in its original condition and packaging, with proof of purchase.

No restocking fee applies to eligible returns. Customer-arranged return shipping is paid by the customer unless the item was defective or supplied in error. Any final-sale restriction must be disclosed before purchase and does not exclude remedies for defects or errors. Issues generally not covered

Minor natural variation and permitted substitutions. Damage caused by improper care, heat exposure, misuse, accidents, or handling after delivery. Problems caused by inaccurate customer information. Dissatisfaction based solely on a change of mind after an arrangement has been prepared. These exclusions do not apply to defects or errors attributable to us.

Refund timing: We initiate approved refunds to the original payment method within 5 business days. Your bank or processor may require another 5–10 business days to post the funds.

Store credit: Store credit does not expire and cannot be exchanged for cash except where required by law.

  1. Custom Orders, Events and Large Orders

Event bookings, custom installations, and orders totaling $500 or more before taxes and delivery require a signed written agreement. Ordinary arrangements below this amount generally follow the standard order policies.

Booking and payment

Deposit: A 30% deposit reserves the date and authorizes planning and purchasing. Final payment: The balance is due 14 calendar days before the event or delivery. Short-notice bookings: Bookings made within 14 days require full payment. Final details: Quantities, designs, delivery instructions, and venue details must be finalized 14 calendar days before fulfillment. Late additions: Additions are subject to availability and additional payment. Reductions: Reductions after the final-details deadline do not reduce charges for work or materials already committed. Event cancellations

Unless the signed agreement states otherwise:

Cancellation notice

Cancellation charge

More than 30 calendar days before the event

Up to 30% of the total

15–30 calendar days before the event

Up to 50% of the total

14 calendar days or fewer before the event

Up to 100% of the total

Cancellation charges cover completed planning, labor, nonrecoverable purchases, and reasonably supportable losses from reserving the date. We account for costs avoided and amounts recovered through reuse or resale, do not charge twice for the same loss, and refund payments exceeding the applicable charge.

Nonpayment: We will notify you of overdue payment and provide a reasonable opportunity to pay before cancelling. Cancellation charges remain subject to the terms above. Business cancellation: If we cancel without customer fault, we refund amounts paid for products and services not provided. Rentals: Rental items remain our property. Return dates and replacement values are stated in the agreement. Documented loss or damage beyond normal wear is invoiced. A stored card is charged only with appropriate authorization. Access and delays: You are responsible for arranging venue access and approvals. Customer- or venue-caused waiting time and extra labor are billed at $50 per staff member per hour, in 30-minute increments, after the first 30 minutes. We notify you before additional charges accrue when practical. Quotes: Quotes remain valid for 14 calendar days. Confirmed prices are not increased without your agreement, except for approved scope changes.

  1. Chargebacks, Fraud and Disputes

Please contact us promptly about a billing or order problem so we can try to resolve it.

Contacting us first is encouraged, but is not a condition of exercising lawful payment-dispute rights. We may provide the payment processor or card issuer with relevant order records, policy acceptance, communications, and delivery evidence. We do not impose a separate administrative fee simply because you dispute a payment. We may request reasonable identity or payment verification and cancel suspicious orders. Suspected fraud may be reported to the payment processor or appropriate authorities. We may decline future orders involving documented fraud, bad-faith conduct, or abuse of staff, consistent with applicable law.

  1. Safety and Use of Products

Flowers and decorative products are not intended for consumption unless specifically sold as edible. Some flowers and plants are toxic to pets or people. Tell us about required exclusions before ordering. Keep floral preservatives, wires, pins, glass, and other arrangement components away from children and pets. Follow care instructions and any manufacturer warnings. Never leave burning candles unattended or place them near flowers, packaging, or other flammable materials. Manufacturer warranties may apply to third-party products, without excluding rights or responsibilities imposed by law. We are not responsible for harm caused by misuse or failure to follow instructions to the extent permitted by law. This does not excuse our own legally actionable conduct.

  1. Privacy and Communications

We use customer and recipient information to process payments, prepare and deliver orders, provide support, prevent fraud, and meet legal obligations.

We may share necessary information with service providers such as payment processors, website providers, and delivery partners. We do not sell personal information.

Order updates: We may use your provided contact details for communications about your order, subject to applicable consent requirements. Message and data rates may apply. Marketing: Promotional emails and texts require the applicable separate consent. Marketing consent is not a condition of purchase. Follow the unsubscribe instructions or reply STOP to promotional texts to opt out. Recipient information: Provide another person’s details only when you have authority or a legitimate basis to share them for delivery. Photographs: We may photograph arrangements for quality records and marketing. Published photographs will exclude identifying customer details, private messages, faces, and addresses unless permission is obtained. Personalization: You confirm that you have the necessary rights to text, images, and logos submitted for your order. We may refuse unlawful or infringing content. Any separate website Privacy Policy explains website data collection, cookies, retention, and applicable privacy choices in more detail.

  1. Limitation of Liability

To the extent permitted by law, our liability for an ordinary order-related claim is limited to the amount paid for the affected order.

To the extent permitted by law, we are not responsible for indirect or consequential losses, such as lost profits or expenses arising from a missed event.

These limits do not apply to fraud, intentional misconduct, gross negligence, or liabilities and consumer rights that cannot legally be excluded or limited. Nothing in these policies excludes warranties that applicable law requires.

  1. Events Beyond Our Reasonable Control

Severe weather, natural disasters, government restrictions, outages, and other events beyond our reasonable control may affect fulfillment.

We will contact you as soon as reasonably possible and discuss available alternatives.

If we cannot fulfill a standard order within the agreed or reasonably acceptable timeframe, you may choose rescheduling or a refund for unprovided products and services. Store credit is optional.

For events, we will seek a mutually acceptable rescheduling arrangement. If rescheduling is not possible, we will refund unspent amounts. Any retained amount must reflect documented completed work or nonrecoverable costs permitted by the signed agreement and applicable law.

  1. Governing Law and Disputes

These policies are governed by Florida law, subject to any mandatory protections that apply to your purchase.

Please contact us to attempt a good-faith resolution. We aim to resolve concerns within 30 days, but this process does not prevent either party from meeting legal deadlines, exercising payment-dispute rights, or seeking urgent relief.

Where legally permitted, court proceedings will take place in a court with appropriate jurisdiction in Broward County, Florida, including small claims court when applicable.

  1. General Terms

Severability: If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law. Updates: The policy version made available when your order is placed governs that order. Later updates do not retroactively change confirmed purchases. No waiver: Not enforcing a provision in one instance does not waive it in other instances. Staff safety: We may refuse service involving abusive, threatening, or harassing behavior, consistent with applicable law. Order documents: These policies, your confirmed order details, and any signed agreement establish the terms of your purchase. Mandatory legal rights remain unaffected.
